7.   ORDINANCES:   Introduction

#1867 entitled: An Ordinance supplementing the Zoning Ordinance of  the Borough
of South Plainfield, 1992, to provide for administrative mechanisms for the     implementation and maintenance of the Affordable Housing Plan for the Borough of
South Plainfield

#1868 entitled: A Capital Ordinance appropriating $109,000 for the installation of a sanitary sewer as part of the Durham Avenue Phase II Project for the Borough of South Plainfield, County of Middlesex, State of New Jersey

8.   RESOLUTIONS:

#09-276            Authorize release of a Performance Bond for Durham Avenue LLC for
                        public improvements to Block 478, Lots 1.01

#09-277            Authorize release of a Performance Bond for Lordina Builders for public                         improvements to Block 367, Lots 2.08, 2.09 and 2.10 – Spicer Avenue
                       and Delmore Avenue

#09-278           Authorize the Chief Financial Officer to issue a check to the South
                       Plainfield Volunteer Fire Company as reimbursement for the purchase
                       of accidental death and dismemberment coverage for an amount not
                       to exceed $8,000.00 ( VFIS Insurance Quote #4533 ).

#09-279           Authorize the Chief Financial Officer to issue a refund check in the
                       amount of $1,425.00 to JSM @ South Clinton, LLC, Edgewood
                       Properties, Inc., 1260 Stelton Road, Piscataway, NJ 08854 for
                       overpayment of their sewer fees

#09-280           Waive Fire permit fee of $42.00 for the Riley School Halloween Party
                       to be held October 16, 2009 at 6:00pm at Riley School

#09-281            Waive Fire permit fee of $42.00 for the South Plainfield Elks Lodge to hold         their annual Hoop Shoot Contest to be held on October 23, 2009
        from 6pm to 9pm at Riley School

#09-282            Approve a Person to Person liquor license transfer for Plenary Retail                         Consumption License # 1222-33-015-005 from
                       South Plainfield Hotel, LLC to South Plainfield Lodging Realty, LLC,
                       for premises located at 4701 Stelton Road, effective January 1, 2010.

#09-283            Waive Fire Permit fee of $42.00 for the South Plainfield Eagles to hold a                         Bonfire on November 14, 2009 at the Kenneth Ave complex.

#09-284            Authorize a Temporary Budget Amendment for Transition Budget 2009 in                         the amount of $380,000.00 in the Current Fund

#09-285           Authorize the Mayor and Municipal Clerk to enter into a professional
                       services contract with Brown and Brown to provide Actuarial services
                       in computing the Government Accounting Standard Board (GASB 45)
                       Liability and related values
for the Borough’s “Other Postemployment                         Benefits” (OPEB), at a cost not to exceed $8,500.00.

#09-286           Authorize the Chief Financial Officer to issue a check in the amount
                       of $43.00 to G. Leonardis of Hamilton Blvd. as a refund for overpayment
                       of an inspection fee Permit # 091060.

#09-287            Authorize the Chief Financial Officer to issue a refund check in the amount
                        of $24.00 to Billy Staats of 136 Jerome Avenue, for overpayment of an
                        inspection fee Permit # 060514.

#09-288            Waive Fire Permit fee of $42.00 for the Sacred Heart Church Christmas                         Concert to be held on November 29, 2009 at the Church.

#09-289            Authorize the Mayor and Municipal Clerk to renew a Software Maintenance                         Agreement with Queues Enforth Development, Inc,  (QED),
                        renewal term of January 1, 2010 through December 31, 2010 at a cost
                        of $28,950.00 plus Consultation and/or Training Service fees of $175.00                         per hour plus expenses.

#09-290            Waive Fire Permit fee of $42.00 for the St. Stephen the Protomartyr                         Antiochian Orthodox Church for their Tricky Tray event
                        which was held on October 16, 2009 at the Church Hall.

#09-291            Waive Fire Permit fee of $42.00 for the South Plainfield School District's                         Annual District Festival to be held on March 11, 2010 in the High School                         Auditorium.

#09-292            Accept the Retirement letter of DPW Superintendent Joseph Glowacki,                         effective December 31, 2009.

#09-293            Authorize the Borough Engineer, CME Associates, to provide professional                        engineering services including the design, the bid and the construction                        administration phases of this project at a cost not to exceed $4,781.00.

#09-294            Approve a Block Party requested by Dawn Maurer for Saturday, October 31,                         2009 from 2:00pm to 10:00pm on Garden Drive from one end of Robert
                        Place to the other end.                                            

#09-295            Authorize a Temporary Capital Budget Amendment in the amount of                         $109,500 for the installation of a sanitary sewer as part of the
                        Durham Avenue Phase II Project  subject to the execution of a
                        Developer’s Agreement with Progressive Insurance.

#09-296             Authorize the Mayor and Municipal Clerk to execute a contract with Stilo
                         Excavating of South Plainfield, the successful responsible bidder on                         the Durham Avenue Phase II improvement project, at a cost not to
                        exceed
$189,903.00 subject to execution of the Developers’ Agreement
                        with Progressive Insurance for the sanitary sewer portion
                         of the project.                    

#09-297            Approve a Person to Person and Place to Place transfer of Retail Plenary                         Consumption License # 1222-33-003-006 from Uno Restaurants LLC
                       located at 4901 Stelton Road, South Plainfield, NJ to Ignite Restaurants
                        – New Jersey, Inc., d/b/a Joe’s Crab Shack and Brick House Tavern & Tap
                       located at 4901 and 4905 Stelton Road, South Plainfield, NJ,
                       effective November 1, 2009
