9.    Public Hearing on the transfer of Liquor License # 1222-33-003-006 from Uno Restaurants to Ignite Restaurants, Inc. d/b/a Joe’s Crab Shack and Brick House Tavern Public.  To be considered are a waiver of Article 67-6 of the Code of the Borough of South Plainfield pertaining to the allowable distance between liquor licenses and a dual location operation under a single license.

11.   ORDINANCES:    Public Hearing and Final Adoption  

#1867 entitled: An Ordinance supplementing the Zoning Ordinance of the Borough
                of South Plainfield, 1992, to provide for administrative mechanisms for       
                the implementation and maintenance of the Affordable Housing Plan
                for the Borough of South Plainfield

#1868 entitled: A Capital Ordinance appropriating $109,381.70 for the installation of a                sanitary sewer as part of the Durham Avenue Phase II Project
                for the Borough of South Plainfield, County of Middlesex, State of New Jersey

12.  ORDINANCES:  Introduction

#1869 entitled: An ordinance to amend Ordinance #1622 establishing a service agreement                 and rate of payment for police officers rendering service to the NJ Motor
                Vehicle Commission under the Law Enforcement Agency Security
                Enhancement Program

#1870 entitled: An Ordinance amending Ordinance # 1826 entitled: An Ordinance                  amending Chapter 146 of the Code of the Borough of South Plainfield, “                  Peddling and Soliciting”, as supplemented and amended.

13.  RESOLUTIONS:

#09-295    Authorize a Capital Budget Amendment in the amount of $109,381.70 for the                 installation of a sanitary sewer as part of the Durham Avenue
                Phase II  Project. This resolution is subject to the execution of a
                Developer’s Agreement with Progressive Insurance.

#09-296    Appoint Linda Zushma to the position of Housing Liaison in conjunction with                 Ordinance # 1868 at a salary of $4,500.00 per year, effective
                November 10, 2009

#09-297     Approve a Person to Person and Place to Place transfer of Retail Plenary                 Consumption License # 1222-33-003-006 from Uno Restaurants
                LLC located at 4901 Stelton Road, South Plainfield, NJ to Ignite
                Restaurants – New Jersey, Inc., d/b/a Joe’s Crab Shack and Brick House
                Tavern & Tap located at 4901 and 4905 Stelton Road,
                South Plainfield
, NJ
, effective November 10, 2009

#09-298     Authorize Met Life to provide the “Met Life Performance Plus Account” as an                  alternative to the borough’s existing deferred compensation plans.

#09-299    Authorize CME Associates to provide professional engineering services related to the       
                    Decorative Street Lighting project on Lakeview Ave and Plainfield Ave
                    at a cost not to exceed $22,000.00.  The scope of work includes Design,
                    Bid and Constructions phases.

#09-300     Authorize the Chief Financial Officer to issue a check in the amount of $983.54                  for overpayment of taxes on Block 157, Lot 6, 1529 Frase St. to Thomas and                  Janet Grassi

#09-301    Pursuant to the provision of the N.J.S.A. 54:4-3.30, authorize the Tax
Collector to designate the property known as Block 229, Lot 29, commonly
known as 3138 Park Avenue as 100% tax exempt at the local level due to a qualified Veterans’ Disability, commencing on May 3, 2008 and make the
necessary refunds and adjustments as indicated.

 

#09-302     Authorize the Chief Financial Officer to issue a check in the amount of
                $1406.25 for overpayment of taxes on Block 195, Lot 24, also know as
                Daniel Street
to Tracey L. Duhamel

 

#09-303    Authorize the Mayor and Municipal Clerk to execute a professional service agreement with Edmunds & Associates, Inc., 301-A Tilton Road, Northfield,
New Jersey 08225
for a Fiscal to Calendar Year Budgetary conversion at a
cost not to exceed $7,000.00.

 

#09-304    Authorize a settlement with Denco Construction in the amount of $81,000.00
as full and final settlement of the claim filed against the Borough for the
Detective / Juvenile facility project

 

#09-305    Waive Fire Permit Fee of $42.00 for Summer Drama Workshop fundraiser to be
held on November 21, 2009 at the PAL Building from 10am to 4pm for Fall
Vendor Day.

 

#09-306     Authorize the Mayor and Municipal Clerk to execute an contract with Stilo                 Excavating, Inc., 2907 South Clinton Avenue, South Plainfield, New Jersey                 07080, the successful bidder for improvements entitled Durham Avenue
                Phase II project, pending the execution of the Developer’s Agreement
                with Progressive Insurance. 

 

#09-307    Authorize a professional services agreement with Lee Fox to conduct an auction
on behalf of the Borough of municipal property which no longer has a useful purpose to the Borough

 

#09-308    Authorize a Taxpayer grace period to December 15, 2009 for the payment of 4th quarter 2009 taxes wherein interest will not be charged on this payment period

 

#09-309    Authorize the Chief Financial Officer to issue a refund check to Selahatti
                Karaoglu in the amount $50.00 due to the rejection of a solicitor permit
                application

#09-310    Authorize the Mayor and Municipal Clerk to execute an agreement with
Joseph B. DeAndrea Jr. AIA, PA,2201 South Clinton Ave., South Plainfield,
to provide Architectural Services for the renovation of 2 lavatories in
Borough Hall including design, bid phase and construction phase of the
project, at a cost not to exceed $8,250.00.

 

 

#09-311     Authorize the Mayor and Municipal Clerk to execute an agreement with S.                  Brothers, Inc. P.O. Box 317, South River, NJ 08879  for the
                installation of ADA compliant handicap curb ramps at a cost
                not to exceed $16,563.00.

#09-312     Authorize the Governing Body of the Borough of South Plainfield  to request
                the Director of the Division of Local Government Services to
                approve theinsertion of a Chapter 159 item of revenue in the TY 2009 budget
                in the sum of $68,100.00 for ADA improvements to Municipal Building

 

#09-313     Authorize the Governing Body of the Borough of South Plainfield  to request
                the Director of the Division of Local Government Services to approve                   the insertion of a Chapter 159 item of revenue in the TY 2009 budget in
                the sum of $12,000.00 for Senior Services

 

#09-314     Authorize the Governing Body of the Borough of South Plainfield  to request
                the Director of the Division of Local Government Services to approve  
                the insertion of a Chapter 159 item of revenue in the TY 2009 budget in the                  sum of $23,629.00 for ADA compliant handicap accessible curb ramps

 

#09-315     Authorize the owners the property at 109 Vakerich Place to erect a deck in the                  rear of their property over an existing easement conditioned upon
                 the agreement that should the Borough require access to said easement,
                 the property owner will remove said deck.
